This Law Enforcement Access Policy (“Policy”) explains how YourSitee (“we,” “us,” or “our”) reviews and responds to requests from law enforcement agencies, courts, regulatory bodies, and other government authorities (“Authorities”) seeking access to user information. This Policy is intended for authorized representatives of Authorities. It does not create a right to receive information and does not guarantee that any requested data will be preserved or disclosed.

Contact information

Law enforcement and government requests should be sent to: Digital correspondence is strongly preferred. Requests sent by physical mail may take significantly longer to receive and process.

1. General principles

1.1. We protect the privacy and security of user information in accordance with applicable law, including the EU General Data Protection Regulation (“GDPR”), Hungarian Act CXII of 2011 on Informational Self-Determination and Freedom of Information (“Infotv.”), and other applicable Hungarian and European Union requirements. 1.2. Non-public user information is disclosed only when:
  • Disclosure is required or permitted by applicable law and supported by valid legal process; or
  • An emergency disclosure is necessary and proportionate to prevent an imminent risk of death or serious physical harm, where permitted by applicable law.
1.3. Every request is reviewed for:
  • Legal authority and jurisdiction
  • Authenticity and validity
  • Necessity and proportionality
  • Scope and specificity
  • The connection between the requested data and the stated legal purpose
  • Compliance with applicable data protection and procedural law
1.4. Requests that are invalid, excessively broad, vague, disproportionate, or insufficiently supported may be rejected, challenged, narrowed, returned for clarification, or otherwise not processed. 1.5. Where disclosure is legally required, we provide only the minimum information necessary to comply with the valid request. 1.6. We do not provide information that is not in our possession or control, and we do not create new data solely to respond to a request. Requests should be written, signed, and submitted on official agency, court, or government letterhead. Requests sent by email should normally originate from an official government or agency-controlled email domain. Each request should include:
  • The full name of the requesting Authority
  • The requesting official’s name, title, badge number or official identification number, where applicable
  • Official contact details
  • The relevant case, investigation, or reference number
  • The legal basis for the request
  • The jurisdiction and authority under which the request was issued
  • A copy of the applicable subpoena, court order, warrant, production order, preservation order, or equivalent legal instrument
  • Sufficient information to identify the relevant account, such as a username, YourSitee URL, or email address
  • A precise description of the information requested
  • The relevant date or time range
  • An explanation of how the requested information relates to the investigation or proceeding
  • The requested response deadline and the legal or operational reason for that deadline
  • The legal basis for any requested restriction or delay of user notification
Requests should be provided in a non-editable format, such as a signed PDF, where reasonably possible. We may independently verify the identity and authority of the requesting official before taking any action.

3. Preservation requests

We may preserve specified existing data in response to a valid and legally binding preservation request or order issued under applicable law. Preservation:
  • Prevents identified existing data from being deleted for the legally required period
  • Does not authorize disclosure of that data
  • Does not require YourSitee to begin collecting new categories of information
  • Does not apply to information that no longer exists or is not in our possession or control
A preservation request must:
  • Clearly identify the relevant account
  • Specify the exact categories of data to be preserved
  • Define the relevant date or time range
  • State the applicable legal authority
  • Identify the requested preservation period
  • Be signed or otherwise authenticated by an authorized official
Data will be preserved for the period specified in the legally valid request or order, subject to the maximum period permitted by applicable law. Any extension must be supported by an additional valid legal basis or legal instrument received before the existing preservation period expires.

4. Requests for user information

Non-public user information will only be disclosed in response to legally valid and binding process issued by an Authority with appropriate jurisdiction, or where disclosure is otherwise required or permitted by applicable law. Depending on the jurisdiction, requested data, and circumstances, valid legal process may include:
  • A court order
  • A judicial warrant
  • A subpoena
  • A production order
  • An order issued by a competent prosecutor or investigative authority
  • An applicable European Production Order
  • Another equivalent and legally enforceable instrument
The existence of an investigation, an informal request, or an Authority’s general interest in an account is not by itself sufficient to require disclosure.

5. Emergency disclosure requests

We may disclose limited information without ordinary legal process where we reasonably and in good faith believe that:
  • An emergency presents an imminent risk of death or serious physical harm;
  • The requested information is necessary and proportionate to addressing that risk; and
  • Disclosure is permitted by applicable law.
Emergency requests must use the subject line: Emergency Disclosure Request The request must include:
  • The requesting Authority and official’s identity
  • Official contact information
  • A signature or other reliable authentication
  • The identity of the person or people at risk, where known
  • A detailed description of the emergency
  • The nature and immediacy of the threatened harm
  • The specific information requested
  • An explanation of how the requested information could prevent or reduce the harm
  • The deadline by which the information is required
  • Confirmation that ordinary legal process cannot be obtained in time
We may contact the requesting Authority through independently verified contact information before responding. Submission of an emergency request does not guarantee disclosure. Any disclosure will be limited to information reasonably necessary to address the identified emergency.

6. International and cross-border requests

Requests from Authorities outside Hungary must be submitted through a legally recognized channel applicable to the requesting Authority, jurisdiction, and requested data. Depending on the circumstances, appropriate channels may include:
  • Mutual Legal Assistance Treaties
  • Letters rogatory
  • European Investigation Orders
  • European Production Orders or European Preservation Orders, where applicable
  • Cooperation mechanisms established under applicable international agreements
  • Other procedures recognized under Hungarian or European Union law
Requests from Authorities outside the European Economic Area are assessed under Article 48 and Chapter V of the GDPR, together with any applicable international agreement or other lawful transfer mechanism. A judgment, order, or administrative decision issued by an Authority outside the European Economic Area does not by itself constitute a sufficient legal basis for transferring personal data. We may require an Authority to use the appropriate Hungarian, European Union, or international judicial-cooperation procedure before information can be preserved or disclosed.

7. User notification

Where legally permitted and appropriate, YourSitee may notify a user that their information has been requested or disclosed. Notification may be delayed, restricted, or withheld where:
  • A binding law, court order, or other valid legal instrument prohibits notification
  • Notification would create a material risk to an investigation
  • Notification could endanger another person
  • Notification could compromise public or national security
  • Notification could lead to the destruction or concealment of evidence
  • Another lawful and proportionate reason prevents notification
Authorities requesting delayed or restricted notification should clearly identify:
  • The legal basis for the restriction
  • The requested duration
  • The reasons the restriction is necessary and proportionate
Where a temporary restriction expires, we may notify the affected user unless continued non-disclosure is legally required or otherwise permitted by applicable law.
